    The agreement covering reservations, payments, and your visit to War Eagle Resort on the Illinois River in Tahlequah, Oklahoma.

    The short version: every stay includes a float trip, deposits are non-refundable, your balance is charged automatically on your start date, online changes close 12 hours before you arrive, life jackets are required for anyone 12 or younger, and card payments are handled securely by Square. Details below.

    1. Who we are and what these terms cover

    These Terms of Service (“Terms”) are an agreement between you and War Eagle Resort Inc., 13020 N Hwy 10, Tahlequah, OK 74464 (“War Eagle Resort,” “we,” “us”). They cover this website, guest accounts, reservations for float trips, lodging and camping, and your visit to the property.

    By creating an account, booking a reservation, or entering the property, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not book or use the site.

    2. Eligibility and guest accounts

    You must be at least 18 to create an account and at least 21 to reserve and check in to lodging. The person who books is the reservation holder and is responsible for everyone in their party, including minors, and for the accuracy of the information provided.

    Keep your sign-in credentials private, and keep your contact details current so we can reach you about your trip. Automated sign-ups, scraping, or use of the booking system to hold inventory you do not intend to use are not permitted, and we may cancel affected accounts and reservations.

    3. Season and booking window

    Our operating season runs from May 1 through the last Sunday of September each year. Online reservations are only available for dates inside that window.

    Off-season stays, group events, and special arrangements are handled by phone. Call (918) 456-6272 and our staff will build the reservation with you.

    4. Reservations and the float requirement

    Every lodging and camping reservation includes at least one float trip on the Illinois River with War Eagle Resort. Housing and camping are for guests floating with us.

    No private floating equipment is allowed on the property or at our put-in and take-out — no exceptions. Rafts, kayaks, life jackets, paddles, the shuttle, taxes, and day parking are part of your float reservation.

    Availability is confirmed at the moment your reservation is created. While you are checking out we hold your selected room or site briefly; if that hold expires and the unit is taken, we will show you what is still available so you can finish without starting over.

    Every vehicle staying in the campground must check in at the office so its information is noted with the campsite reservation. Our security patrols use that information to identify all vehicles during rounds.

    5. Prices, deposits and payment

    Rates, deposits, and applicable taxes and fees are shown before you confirm. Prices may change season to season, but the total shown when you book is the total for that reservation unless you change it later.

    A non-refundable deposit is charged when you book. The remaining balance is charged automatically on your reservation start date to the card kept on file for the reservation. Camping reservations are charged in full at booking.

    Card payments are processed by Square (Block, Inc.), our payment processor and the merchant of record for online payments. Your card details are entered into Square’s secure systems. We never see or store your full card number — only a secure reference token that lets us charge the balance on your arrival date. Square’s Payment Terms and Privacy Notice govern Square’s handling of payment information.

    We accept American Express, Discover, Mastercard, and Visa online, and cash in person at the office. We do not accept checks. Chargebacks filed instead of contacting us may result in collection of amounts owed and loss of booking privileges.

    Cash discount at check-in: if you pay your remaining balance in cash at check-in, you save 3% — the credit card processing fee — calculated on your full reservation total including the deposit. Your reservation summary always shows both the card balance and the discounted cash balance. The deposit paid at booking is always charged by card and is non-refundable.

    6. Changes, cancellations and no-shows

    All deposits are non-refundable and non-transferable. We hold your spot the moment you book.

    You can change your own reservation online — float days, vessels, dates, accommodations, and party members — until 12 hours before your reservation start. Inside that 12-hour window, changes and cancellations are handled by our staff by phone at (918) 456-6272. If a change increases your total, the difference is added to the balance charged on your start date.

    Guests who do not arrive are recorded as a no-show and remain responsible for the non-refundable deposit. The river is a natural waterway: high water, storms, or Grand River Dam Authority action can close floating on short notice. When we cannot run trips for safety reasons, our staff will work with you on the best available option for your dates.

    7. Rules of the resort and the river

    These rules exist for everyone’s safety and are part of your reservation. Full details are posted on our Float Trips, Lodging, Camping, and River Safety pages.

    • Anyone 12 or younger must wear a Coast Guard approved life jacket at all times on the water, as required under Grand River Dam Authority rules for the Illinois River.
    • Riders must be at least 2 years old for a raft; kayaks are for guests 16 and older.
    • Vessel, site, and party capacity limits are firm and are enforced at check-in.
    • No glass and no styrofoam on the river. No hard liquor and no jello shots. No coolers over 50 quarts.
    • Be off the river at the War Eagle take-out by 6pm; late or off-property pull-outs carry a retrieval fee.
    • Quiet hours are 11pm-7am. Check-in is 3–6pm weekdays and 3–9pm weekends. Check-out is 11am.
    • Pets are not allowed in housing (service animals excepted). Dogs are welcome in the campground on a leash and never unattended, and may float with their owners in a raft, never a kayak. Aggressive animals are not permitted anywhere on the property, the bus, or the water.
    • No smoking or vaping in housing; smoking inside adds a cleaning fee.
    • Campfires only in provided fire pits or established campground spots.

    Our staff may refuse service, end a float, or end a stay without refund for unsafe, unlawful, or abusive conduct, for exceeding capacity limits, or for repeated rule violations.

    8. Release of liability and waivers

    Every person who floats with us must have a signed Release of Liability on file. Adults sign for themselves; a parent or legal guardian signs for each minor. Waivers can be signed online before your trip or at the office at check-in.

    If anything in these Terms conflicts with the signed waiver, the signed waiver controls for the activities it covers. Guests without a completed waiver cannot board the bus or the water.

    9. Assumption of risk

    Floating, swimming, wading, camping, and moving around a riverfront property involve inherent risks that cannot be eliminated: moving water and changing river levels, submerged rocks and debris, slick banks and rocky footing, weather, wildlife and insects, and the actions of other guests. You knowingly accept those risks for yourself and everyone in your party.

    Our staff are not lifeguards and are not medical providers. In an emergency we will call for local emergency services. You are responsible for your own health decisions, medications, and insurance coverage, and for supervising the children in your party at all times.

    10. Damage, lost equipment and site condition

    You are responsible for damage to lodging, campsites, vessels, and resort property caused by your party, and for equipment that is lost, abandoned on the river, or not returned. Charges for damage, excessive cleaning, missing gear, retrieval, or unreturned wristbands and permits may be applied to the card on file after we notify you of the amount.

    11. Disclaimers and limitation of liability

    River level, flow, water temperature, and weather information on this site comes from public sources such as the U.S. Geological Survey and the National Weather Service and is provided for general planning only. It is not a safety guarantee, and conditions can change quickly.

    The website and its content are provided “as is” without warranties of any kind. To the fullest extent Oklahoma law allows, War Eagle Resort Inc. and its owners, staff, and contractors are not liable for indirect, incidental, or consequential damages, and our total liability arising from a reservation will not exceed the amount you paid for that reservation. Nothing in these Terms limits liability that cannot be limited by law. You agree to indemnify us for claims arising from your party’s conduct or rule violations.

    12. Website content and photography

    The War Eagle Resort name, logo, text, photographs, and site design are our property or licensed to us and may not be copied for commercial use without permission. Anything you submit through the site — reviews, notes, photos, messages to our assistant — must be yours to share, and you grant us permission to use it to operate the resort and respond to you. We may photograph general activity on the property for promotional use; tell the office if you would rather not appear.

    13. Governing law and disputes

    These Terms are governed by the laws of the State of Oklahoma. Any dispute will be brought in the state or federal courts serving Cherokee County, Oklahoma. Please contact us first — nearly everything is resolved with a phone call. If any provision is found unenforceable, the rest stays in effect.

    14. Changes to these Terms and how to reach us

    We may update these Terms as our operations change. The “Last updated” date above shows the current version, and the terms in effect when you booked apply to that reservation.
